Terms and Conditions

3.1 Age Requirement

Users must be at least 13 years of age to use our Platform. Users between 13-18 years must have parental or guardian consent. By using our Platform, you represent and warrant that you meet these age requirements.

3.2 Account Creation

To access certain features, you must create an account by providing accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information remains accurate and up-to-date

4.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for educational purposes only.

4.2 Prohibited Activities

You agree NOT to:

• Use the Platform for any illegal or unauthorized purpose
• Violate any laws, including intellectual property laws
• Share or distribute assessment content without authorization
• Attempt to circumvent security measures or access restrictions
• Use automated systems (bots, scrapers) to access the Platform
• Interfere with or disrupt the Platform's functionality
• Impersonate any person or entity
• Upload viruses or malicious code
• Collect or harvest user information without consent
• Use the Platform for commercial purposes without our written consent

4.3 AI Tutor Usage Policy

Our AI Tutor feature is subject to fair usage limits to ensure optimal service quality for all users:

• Usage Limits: Gold Plan subscribers are allocated a maximum of 1,500 AI tutor requests per subscription period. This includes all interactions with the AI tutor feature.
• Fair Usage: The AI Tutor is intended for educational purposes only. Excessive, abusive, or automated usage that exceeds reasonable educational needs is strictly prohibited.
• Monitoring: We reserve the right to monitor AI Tutor usage patterns to detect and prevent misuse, including but not limited to automated bot usage, spam requests, or attempts to circumvent usage limits.
• Consequences of Misuse: If we determine, in our sole discretion, that you have violated this AI Tutor Usage Policy by exceeding reasonable usage limits or engaging in abusive behavior, we reserve the right to:
  • Immediately suspend or restrict your access to the AI Tutor feature
  • Terminate your subscription without refund
  • Permanently ban your account from accessing our Platform
  • Take legal action if warranted
• No Refund for Violations: In cases of policy violations, subscription fees are non-refundable, regardless of the timing of the violation or remaining subscription period.
• Request Limit Exhaustion: Once your allocated 1,500 requests are exhausted, AI Tutor access will be automatically suspended until the next billing cycle. Additional request packages may be made available for purchase in the future.

5.1 Subscription Plans

We offer various subscription plans including free trial, monthly, and annual subscriptions. Pricing and features are displayed on our Platform and may be updated from time to time.

5.2 Payment Processing

All payments are processed through secure third-party payment gateways (Razorpay) in compliance with Indian payment regulations. By providing payment information, you authorize us to charge the applicable fees.

5.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will be charged the then-current subscription fee.

5.4 Refund Policy

In accordance with Indian consumer protection laws, refunds may be issued at our discretion within 7 days of purchase if no significant use of services has occurred. Refund requests must be submitted to our support team with valid reasons.

No Refunds for Policy Violations: Subscriptions terminated due to violations of these Terms, including but not limited to AI Tutor misuse, excessive usage, or any prohibited activities, are not eligible for refunds under any circumstances. The Company reserves the right to cancel subscriptions with no refund based on usage patterns that violate our Fair Usage Policy.

6.1 Our Intellectual Property

All content, features, and functionality on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, assessment questions, solutions, study materials, AI-generated content, algorithms, source code, and the compilation thereof (collectively, the "Platform Content") are the exclusive property of AimHigh or its licensors and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property laws.

COPYRIGHT WARNING: All Platform Content is protected by copyright laws. Unauthorized copying, reproduction, distribution, modification, public display, public performance, or creation of derivative works of any Platform Content is strictly prohibited and constitutes infringement under the Copyright Act, 1957 and Information Technology Act, 2000.

6.2 Prohibited Uses of Intellectual Property

You are expressly prohibited from:

• Copying, downloading, or extracting assessment questions, answers, or study materials in any form
• Taking screenshots, screen recordings, or photographs of Platform Content for unauthorized distribution
• Sharing, selling, or commercially exploiting any Platform Content
• Reverse engineering, decompiling, or disassembling any software or algorithms
• Removing or modifying any copyright notices, trademarks, or proprietary markings
• Creating derivative works based on Platform Content without express written permission
• Using Platform Content for training AI models or machine learning systems
• Publishing or distributing Platform Content on any other website, platform, or medium

6.2.1 Specific Restrictions on Questions and MCQs

STRICTLY PROHIBITED: All assessment questions, multiple-choice questions (MCQs), answer keys, solutions, explanations, and related content are proprietary intellectual property of AimHigh and are protected under copyright law.

You are specifically and absolutely prohibited from:

• Copying or reproducing any questions, MCQs, or answer options in any format (handwritten notes, typed documents, digital files, etc.)
• Taking screenshots or screen recordings of any assessment questions, MCQs, answer choices, explanations, or results pages
• Photographing questions or MCQs displayed on any device screen using cameras, phones, or any recording device
• Sharing or discussing specific questions, MCQs, or answers with anyone outside the Platform, including on social media, messaging apps, forums, or study groups
• Posting or uploading questions, MCQs, or answers to any external website, application, social media platform, or online community (including but not limited to WhatsApp, Telegram, Discord, Reddit, Quora, or educational forums)
• Creating question banks or compilations of our assessment questions and MCQs
• Memorizing and reproducing questions or MCQs for the purpose of sharing or commercial use
• Using questions or MCQs to create similar or derivative assessments for any purpose
• Selling, trading, or commercializing access to questions, MCQs, or assessment content
• Bypassing or attempting to bypass any technical measures we implement to prevent copying or unauthorized access to questions and MCQs

DETECTION AND ENFORCEMENT: We employ advanced monitoring systems, including but not limited to screenshot detection, proctoring technology, usage pattern analysis, and external content monitoring. Any violation will be detected and enforced immediately.

Violation of these intellectual property restrictions may result in:

• Immediate termination of your account without refund
• Civil legal action for damages under Indian copyright laws
• Criminal prosecution under applicable intellectual property statutes
• Injunctive relief preventing further unauthorized use
• Monetary damages including but not limited to ₹10,00,000 (Ten Lakhs) per violation, actual damages, statutory damages, punitive damages, and any profits gained from the infringement—damages may significantly exceed this amount depending on the severity and commercial impact of the violation
• Public disclosure of violation for academic institutions (if applicable)
• Reporting to relevant authorities and law enforcement agencies

6.3 User Content

You retain ownership of any content you submit or upload to the Platform. By submitting content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content solely for providing, improving, and promoting our Services.

You represent and warrant that: (a) you own or have the necessary rights to submit the content, (b) the content does not infringe any third-party intellectual property rights, and (c) you have the authority to grant the license described above.

6.4 DMCA and Copyright Infringement

We respect intellectual property rights and expect our users to do the same. If you believe any content on our Platform infringes your copyright, please contact us immediately at support@aimhigh.com with detailed information including:

• Identification of the copyrighted work claimed to be infringed
• Identification of the allegedly infringing material on our Platform
• Your contact information and electronic signature
• A statement of good faith belief that the use is unauthorized
• A statement that the information provided is accurate

6.5 Trademarks

"AimHigh", the AimHigh logo, and all related names, logos, product and service names, designs, and slogans are trademarks of UTH AI INDIA PVT LTD or its affiliates. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans mentioned on the Platform are the trademarks of their respective owners.

11.1 By You

You may terminate your account at any time by contacting our support team or through account settings. Upon voluntary termination, you will not be entitled to any refund of prepaid subscription fees, except as expressly provided in Section 5.4.

11.2 By Us

We reserve the right to suspend or terminate your access to the Platform immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms and Conditions
• Violation of the AI Tutor Usage Policy or Fair Usage limits
• Intellectual property infringement or unauthorized content sharing
• Use of automated systems, bots, or scrapers
• Fraudulent activity or payment disputes
• Abusive, threatening, or inappropriate behavior towards other users or staff
• Providing false or misleading information
• Any activity that harms or may harm the Platform, our users, or our reputation

Upon termination by us for violations:

• Your right to use the Platform will cease immediately
• All licenses and rights granted to you will be revoked
• You will NOT be entitled to any refund of subscription fees
• You may be permanently banned from creating new accounts
• We may retain your data as required for legal compliance or to enforce our rights
• We reserve the right to pursue legal action for damages or injunctive relief

11.3 Effect of Termination

Sections of these Terms that by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, indemnification obligations, limitations of liability, and dispute resolution provisions.

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India. Before initiating any legal proceedings, parties agree to attempt resolution through good faith negotiation for a period of 30 days.

16.1 Right to Enforce

AimHigh reserves the right to enforce these Terms to the fullest extent permitted by law. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

16.2 Remedies

In addition to any other remedies available to us under these Terms or applicable law, we may seek injunctive relief, specific performance, or other equitable remedies to prevent or restrain violations of these Terms, particularly regarding intellectual property infringement and unauthorized use of Platform Content.

16.3 Legal Costs

If we are required to take legal action to enforce these Terms or protect our intellectual property rights, you agree to reimburse us for all reasonable costs and expenses incurred, including attorneys' fees, court costs, and investigation expenses, if we prevail in such action.
